Welcome to ARK Digital, a digital marketing services provider under the umbrella of JCF Consulting, LLC (“ARK Digital,” “we,” “our,” or “us”). By accessing or using our website www.arkdigitalworks.com or purchasing any of our services, you (“Client,” “you,” or “your”) agree to be bound by the following Terms and Conditions.
If you do not agree to these Terms, you should not use our website or services.

Services
ARK Digital provides digital marketing services, including but not limited to:

Paid advertising management

Social media marketing and management

Local business profile optimization

Digital strategy consulting
Service details, deliverables, and timelines are outlined in individual client agreements or packages.
Billing & Payment

All plans are billed on a recurring monthly basis and will automatically renew until canceled by the Client.

The Client authorizes ARK Digital to charge the payment method on file each billing cycle.

The Dominance Plan requires a minimum three (3) month commitment due to software complexity. After this initial term, services renew monthly and may be canceled with written notice prior to the next billing cycle.

Payment is due upon receipt of invoice or at the time of automatic charge. Failure to remit payment may result in suspension or termination of services.

All payments are non-refundable unless otherwise required by law.
Cancellation Policy

Clients may cancel at any time by providing written notice (via email to info@thearkcouncil.com) at least 7 days before the next billing date.

Services will remain active until the end of the current paid billing cycle. No prorated refunds will be issued.
Client Responsibilities

Provide accurate and up-to-date information required for service delivery.

Maintain access to platforms (Google, hosting, social media, etc.) needed for ARK Digital to perform services.

Comply with all applicable laws and regulations related to their business and online activities.
Limitation of Liability
ARK Digital and JCF Consulting, LLC are not liable for any indirect, incidental, or consequential damages arising from the use of our services. Liability is limited to the total fees paid by the Client for the specific billing cycle in question.
Intellectual Property

All custom creative assets, websites, and content produced by ARK Digital remain the property of ARK Digital until full payment has been received.

Upon full payment, ownership of final deliverables transfers to the Client unless otherwise stated in a written agreement.

ARK Digital retains the right to showcase completed projects in its portfolio and marketing materials.
Privacy & Data Use

ARK Digital collects only the personal and business information necessary to deliver services.

Client data will not be sold or shared with third parties, except as required by law or to deliver contracted services.

Modifications to Terms
We reserve the right to update or modify these Terms & Conditions at any time. Updates will be posted on www.thearkcouncil.com, and continued use of services after changes constitutes acceptance of the revised Terms.
Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.
